As per Section 4(1) of Citizenship Act,1955, a child born outside India on or after 03.12.2004 shall be a citizen of India by descent, if either of the parents (father or mother) is an Indian citizen at the time of birth of the child and the birth of the child has been registered with the concerned Indian Mission abroad within one year of the birth and the parents of the child have to submit a declaration that the child does not hold passport of another country.
Procedure for Online Registration of Birth
i) An online application has to be made on https://indiancitizenshiponline.nic.in/ . Click on “Registration of birth of a minor child at an Indian Consulate under section 4(1) of the citizenship act, 1955 “ fill the form and upload photo and signatures as per instructions. Form 1 is the correct form.
ii) Print hard copies (in duplicate) of the online application from, duly filled, and submit the same as per instructions given at the Consulate at the given below address. Please note that all copies of the documents including forms should be self attested by both the parents;
iii) Please note that Present Address means your local address here in South Africa or Lesotho.
iv) A self-attested copy of parents passports (first two pages and last two pages); and self attested copy of visa/work permit of both the parent;
v) A self attested copy of birth certificate issued by South African or Lesotho Home Department and also hospital if born in South Africa or Lesotho;
vi) Proof of Payment of fee. Details of the bank are available on https://www.hcipretoria.gov.in/page/pret/. Please note original proof of payment is required and photocopy, faxed copy or scanned copy is not acceptable).
vii) Proof of Residential address in South Africa or Lesotho;
viii) Self attested copy of marriage certificate duly stamped and signed by the competent issuing authority of the marriage certificate. Please note that marriage certificate in the form of Notary Public will not be accepted. Names of spouses should be mentioned on each other's passport as the same is mandatory after getting married. In case, the same is not there, please let us know so that we could guide you on the subject ;
ix) An undertaking from both the parents, duly signed, that child has not taken South African/Lesotho/foreign nationality is to be enclosed. There is a column in the form Part II (column 9, 10 and 11) where both the parents have to sign and write their names below their signatures;
x) Original passport/documents will be returned immediately after verification. High Commission will not be responsible for safe custody of original documents;
xi) In cases of registration of Birth after one year of age, the reason for applying late in writing must be given.
xi) Any other document as specified by the Consular Officer;
